These Terms of Service ("Terms") govern your access to and use of the Nooka Living website located at www.nooka.com.au ("Website"), together with any products, services, content, features and functionality made available through our Website.
Throughout these Terms, the words "Nooka Living", "we", "our" and "us" refer to Nooka Living.
By accessing our Website, creating an account, browsing our products or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Shipping Policy and Returns & Refunds Policy.
If you do not agree with these Terms, you must discontinue use of our Website.
These Terms are governed by the laws of Australia and are intended to comply with the Australian Consumer Law contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth).

Nooka Living is an Australian online retailer specialising in thoughtfully curated furniture, homewares, outdoor living products, children's furniture and lifestyle accessories
Our mission is simple:

2. Eligibility
By using this Website you confirm that:

At Nooka Living, we carefully curate furniture, homewares and lifestyle products that reflect our values of Nature. Comfort. Living Well.
We make every effort to ensure product descriptions, dimensions, specifications, colours and photography accurately represent each product.
However:
- colours may appear differently depending on your monitor, mobile device or screen settings;
- product dimensions are approximate and minor manufacturing tolerances may occur;
- styling accessories shown in photography are for illustrative purposes only unless specifically stated as being included; and
- product packaging may vary from images shown.
We reserve the right to amend product information, specifications or pricing at any time without prior notice where necessary.
10. Natural Materials
Many of our products are crafted using natural materials including timber, stone, marble, travertine, rattan, linen, leather, wool and other organic materials.
Natural materials are unique by nature and may display variations including:
- colour
- grain
- knots
- texture
- veining
- stitching
- finish
- pattern
- minor imperfections
These characteristics are part of the natural beauty of the material and are not considered manufacturing defects.
Likewise, handcrafted products may vary slightly in colour, shape or finish from the images displayed on our Website.
11. Product Availability
All products are offered subject to availability.
While we endeavour to keep stock information current, inventory levels may occasionally differ due to:
- supplier stock updates;
- inventory discrepancies;
- simultaneous purchases;
- shipping delays; or
- circumstances beyond our reasonable control.
If a product becomes unavailable after you have placed an order, we will contact you as soon as reasonably practicable to offer one of the following options:
- a full refund;
- a comparable replacement product (with your agreement);
- a backorder where available; or
- cancellation of the affected item.
12. Pre-Orders & Backorders
Certain products may be offered on a pre-order or backorder basis.
Estimated arrival dates are provided as a guide only and may change due to manufacturing schedules, international shipping delays, customs processing, supplier production or other factors outside our control.
By purchasing a pre-order item, you acknowledge that delivery dates are estimates only and may change.
Where significant delays occur, we will keep you informed and provide options available under Australian Consumer Law.
13. Pricing
Unless otherwise stated:
- all prices are displayed in Australian Dollars (AUD);
- prices include Australian Goods and Services Tax (GST);
- delivery charges are calculated separately during checkout; and
- prices apply only to purchases made through www.nooka.com.au.
Prices may change without notice.
The price charged for your order will be the price displayed at the time your order is successfully submitted.
14. Pricing Errors
Despite our best efforts, pricing, descriptions or promotional information may occasionally contain errors.
Where an obvious pricing or product error has occurred, we reserve the right to:
- cancel the order;
- refuse to supply the product;
- correct the error; or
- contact you with the option to proceed at the correct price.
If payment has already been processed for an order we cannot fulfil due to an error, we will provide a full refund.
Nothing in this clause limits your rights under the Australian Consumer Law.
15. Orders
Placing an order constitutes an offer to purchase products from Nooka Living.
An automated order confirmation email confirms that we have received your order but does not constitute acceptance of your order.
Your order is accepted only when:
- payment has been successfully authorised; and
- we confirm dispatch of your order.
We reserve the right to refuse or cancel any order where:
- payment cannot be authorised;
- products are unavailable;
- an obvious pricing error has occurred;
- fraudulent or suspicious activity is suspected;
- delivery cannot reasonably be completed; or
- the order breaches these Terms.
If your order is cancelled after payment has been processed, you will receive a full refund.
16. Order Changes & Cancellations
Because we aim to dispatch orders promptly, requests to amend or cancel orders cannot be guaranteed once they have been placed.
If you need to change or cancel your order, please contact us immediately at olivia@nooka.com.au.
Where an order has already entered processing or been dispatched, changes or cancellations may not be possible.
Your rights under the Australian Consumer Law are not affected.
17. Payment
We accept payment through the payment methods displayed during checkout.
Payments are securely processed through trusted third-party payment providers.
Nooka Living does not store complete credit or debit card details on its own servers.
By placing an order you warrant that:
- you are authorised to use the payment method provided;
- the payment information supplied is accurate and complete; and
- sufficient funds are available to complete the transaction.
Orders will not be processed until payment has been successfully authorised.
18. Fraud Prevention
To protect our customers and business, Nooka Living reserves the right to verify orders and payment details before dispatch.
Where fraud or unauthorised activity is suspected, we may:
- request additional identification;
- contact you to verify your order;
- delay shipment while verification is undertaken; or
- cancel the order and refund any payment received.
19. Promotions & Discount Codes
From time to time, Nooka Living may offer promotional discounts, voucher codes or special offers.
Unless otherwise stated:
- promotions cannot be exchanged for cash;
- only one promotional code may be used per order;
- promotions cannot be applied retrospectively after an order has been placed;
- promotions may exclude selected brands, collections or sale items;
- promotions cannot be transferred or resold; and
- promotions may be withdrawn or amended at any time without notice.
Additional terms may apply to specific promotions.
20. Gift Cards
Where offered, Nooka Living Gift Cards:
- may only be redeemed through www.nooka.com.au;
- are not redeemable for cash except where required by law;
- cannot be refunded after purchase except as required by Australian law;
- may be used across multiple purchases until the balance reaches zero; and
- should be treated like cash, as lost or stolen Gift Cards may not be replaceable.
Gift Cards are subject to any expiry periods permitted under Australian law.
21. Commercial Purchases
Unless otherwise agreed in writing, products sold through our Website are intended for residential and personal use.
If products are purchased for commercial, hospitality, office or public environments, additional warranties, care requirements or commercial-use limitations may apply.
Please contact us prior to purchase if products are intended for commercial use.
22. Shipping & Delivery
Nooka Living delivers throughout Australia using a network of trusted courier and freight partners.
Delivery costs are calculated during checkout based on the size, weight and destination of your order.
Delivery estimates displayed on our Website are provided as a guide only and are not guaranteed.
While we make every effort to dispatch orders promptly, delays may occur due to circumstances beyond our reasonable control, including:
- supplier delays;
- customs clearance;
- weather events;
- transport disruptions;
- public holidays;
- regional delivery limitations; or
- other unforeseen events.
Nooka Living is not liable for delays caused by third-party freight providers or circumstances outside our reasonable control.
23. Delivery Requirements
Customers are responsible for ensuring:
- delivery details are accurate;
- someone is available to receive the order where required;
- the delivery address is accessible for the selected freight service; and
- products can safely fit through entrances, hallways, lifts, stairwells and doorways.
Please carefully measure your intended space before placing your order.
Nooka Living is not responsible where products cannot be delivered due to insufficient access.
Additional delivery or re-delivery charges may apply if:
- incorrect delivery information has been provided;
- delivery cannot be completed;
- delivery is refused; or
- the carrier is required to make additional delivery attempts.
24. Authority to Leave
Where you authorise a carrier to leave goods unattended at your nominated delivery address, delivery is deemed complete once the goods have been left in accordance with your instructions.
Nooka Living is not responsible for loss, theft or damage occurring after delivery has been completed under an Authority to Leave arrangement.
25. Risk & Title
Ownership (title) of products passes to you once full payment has been received by Nooka Living.
Risk in the products passes to you upon delivery to the nominated delivery address or when the products are collected by you or your authorised representative.
26. Inspection of Goods
We recommend inspecting your order immediately upon delivery and before assembling, installing or using the product.
If you believe an item has been:
- damaged in transit;
- supplied incorrectly;
- missing parts;
- faulty; or
- incomplete,
please notify us as soon as reasonably practicable.
Where possible, please retain all original packaging until your inspection has been completed.
27. Damaged or Incorrect Deliveries
If your order arrives damaged or incorrect, please contact us at olivia@nooka.com.au as soon as possible.
To assist us in resolving your claim efficiently, please provide:
- your order number;
- photographs of the product;
- photographs of the packaging;
- photographs of any shipping labels where relevant; and
- a description of the issue.
Depending on the circumstances, we may arrange:
- replacement parts;
- repair;
- replacement of the product;
- collection of the goods; or
- a refund,
in accordance with the Australian Consumer Law.
Please do not dispose of damaged products or packaging unless authorised by Nooka Living.
28. Furniture Assembly
Many Nooka Living products require customer assembly.
Before commencing assembly, please:
- inspect all components;
- confirm all parts have been supplied;
- check for visible damage or manufacturing defects; and
- read all assembly instructions carefully.
We recommend assembly is completed on a clean, protected surface using appropriate tools.
Nooka Living is not responsible for:
- damage caused during customer assembly;
- incorrect assembly;
- modifications to products;
- normal wear and tear;
- misuse; or
- failure to follow care or assembly instructions.
This clause does not affect your rights under the Australian Consumer Law where a product is faulty.
29. Product Care
Proper care helps maximise the lifespan of your furniture and homewares.
Customers should follow all care instructions supplied with each product.
Natural materials such as timber, stone, rattan, leather, linen and marble require ongoing care and may naturally change over time through exposure to:
- sunlight;
- humidity;
- temperature;
- moisture;
- normal use; and
- ageing.
These natural characteristics do not constitute manufacturing defects.
Damage resulting from misuse, neglect, improper care or failure to follow supplied instructions may not be covered by warranty or the Australian Consumer Law.
30. Returns & Refunds
Our Returns & Refunds Policy forms part of these Terms.
Please refer to our Returns & Refunds Policy for full details.
Nooka Living does not offer refunds, returns or exchanges for change-of-mind purchases.
This includes circumstances where:
- you ordered the wrong product;
- you selected the wrong colour or size;
- the product does not suit your décor or space;
- you no longer require the product; or
- you found the product elsewhere at a lower price.
Nothing in this clause limits your rights under the Australian Consumer Law.
31. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You may be entitled to a repair, replacement or refund where products:
- are faulty or defective;
- are not of acceptable quality;
- are significantly different from their description or sample;
- are not fit for their intended purpose; or
- have a major failure.
Where a product has a major failure, you may choose between a refund or replacement and may also be entitled to compensation for any reasonably foreseeable loss or damage.
Where a product has a minor failure, Nooka Living may choose to repair or replace the product within a reasonable time, as permitted by the Australian Consumer Law.
Nothing in these Terms excludes, restricts or modifies any rights or remedies available to consumers under the Australian Consumer Law.
32. Warranty
Some products may be supplied with a manufacturer's warranty in addition to your rights under the Australian Consumer Law.
Any manufacturer's warranty is provided by the relevant manufacturer and is subject to the terms and conditions supplied with that warranty.
Manufacturer warranties operate in addition to, and do not replace, your statutory rights under the Australian Consumer Law.
33. Force Majeure
Nooka Living will not be liable for any delay or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control.
These circumstances may include, but are not limited to:
- natural disasters;
- bushfires;
- floods;
- pandemics;
- government restrictions;
- industrial disputes;
- supplier shortages;
- manufacturing delays;
- transport disruptions;
- cyber incidents;
- utility failures; or
- other unforeseen events.
Where a Force Majeure event occurs, we will use reasonable efforts to minimise disruption and keep customers informed where practical.
34. Intellectual Property
Unless otherwise stated, all content on this Website is owned by or licensed to Nooka Living and is protected by Australian and international intellectual property laws.
This includes, but is not limited to:

By submitting User Content, you grant Nooka Living a perpetual, worldwide, royalty-free, non-exclusive licence to use, reproduce, publish, modify, distribute and display that content for marketing, promotional and commercial purposes across our Website, social media channels, advertising and other marketing materials.
We reserve the right to edit, refuse or remove User Content at our discretion.

Nooka Living operates its online store using the Shopify ecommerce platform.
While Shopify provides the technology that enables our online store, all purchases made through www.nooka.com.au are made directly with Nooka Living.
Shopify is not responsible for:
- the products we sell;
- order fulfilment;
- warranties;
- customer service;
- returns;
- refunds; or
- any contractual obligations between you and Nooka Living.
38. Website Availability

However, we do not guarantee uninterrupted access.
